The New Jersey State Bar Association’s Labor and Employment Law Section will present the online program “Navigating Workplace Complaints, Accommodations, and Investigations Involving Neurodiversity,” on January 13. Aditi Shah will serve as moderator and Lauren Numeroff will join the panel.
As workplaces become more diverse in how employees process information, employment matters involving neurodivergent workers, including those with autism, ADHD and dyslexia, will increasingly cross an employer’s desk. The panel well address the latest strategies for confidently navigating even the most complex matters. Attendees will learn how differences in communication, sensory processing and executive functioning influence credibility assessments, and how to use that knowledge to get the best results. Our panel of practitioners will also share recent trends in reasonable accommodation requests and misconduct allegations under the Americans with Disabilities Act (ADA) and the New Jersey Law Against Discrimination (NJLAD).
The panel will also address:
- How artificial intelligence is changing these matters, both as an accommodation tool and a potential source of bias in hiring and performance monitoring.
- How to spot common missteps that contribute to mischaracterization or legal exposure during workplace investigations and administrative proceedings
- How neurodiversity affects workplace investigations, administrative complaints and litigation
- Ways communication and social interaction differences influence interviews and credibility assessments
- The growing role of artificial intelligence as an accommodation for neurodivergent employees
- Potential ADA and NJLAD exposure from AI bias in hiring and performance monitoring
- Common missteps that lead to mischaracterization and ineffective decision-making in misconduct allegations
- Practical strategies to account for neurodiversity from the initial complaint through litigation
